Scope and Acceptance
These Terms apply to: (a) your access and use of accessmastersinc.com (the “Site”); and (b) all quotes, sales, installations, repairs, and maintenance services provided by Access Masters for gates, garage door systems, operators, fencing, access control, and related products (collectively, the “Services”). If you do not agree, do not use the Site or our Services.
Website Use
- Eligibility. You must be at least 18 years old (or the age of majority where you live) to use the Site.
- License. We grant you a limited, revocable, non‑exclusive license to access and use the Site for personal or business evaluation of our offerings.
- Prohibited Conduct. You may not: (i) copy, scrape, or reverse engineer the Site; (ii) introduce malware or interfere with the Site’s operation; (iii) use the Site to violate laws or third‑party rights; (iv) use automated tools without our written consent.
- Account Credentials. If the Site offers logins, you are responsible for safeguarding your credentials and all activities under your account.
Quotes, Orders, and Change Orders
- Quotes & Validity. Written quotes/estimates are valid for 30 days unless stated otherwise and are subject to site verification, final measurements, and manufacturer pricing at time of order.
- Approvals & Deposits. Orders become binding when you sign the quote, approve the scope, and pay the required deposit (see Section 6).
- Change Orders. Any modifications (materials, finishes, electrical, masonry, trenching, columns, access control layout, etc.) must be documented in a signed change order and may affect price and timeline.
- Exclusions. Unless expressly included in writing, quotes exclude: permits, engineering, HOA approvals, electrical upgrades, concrete/asphalt restoration, low‑voltage conduit runs beyond specified, Wi‑Fi/networking, painting beyond factory finishes, and landscaping/hardscape restoration.
Site Conditions & Client Responsibilities
- Access & Utilities. You must provide safe site access, clear work areas, and available utilities (power, lighting, and, if required, internet for smart devices).
- Underground & Hidden Conditions. We are not responsible for unmarked utilities, hidden conditions, or code issues not visible during initial assessment. Additional labor/materials to address such conditions will be billed as change orders.
- Third‑Party Coordination. If other trades (electricians, masons, low‑voltage contractors) are required, we can coordinate for an additional fee or you may engage them directly. Our schedule depends on timely completion of prerequisite work.
- Permits & HOA. You are responsible for obtaining HOA architectural approval and required permits unless our quote explicitly includes them. Permit or HOA delays may extend lead times.
Scheduling, Lead Times, and Delays
- Estimated Dates. Lead times for custom gates, doors, operators, and fencing are estimates based on supplier timelines and may change.
- Delivery & Installation Windows. We will provide target installation windows; you agree to be available or designate an authorized representative on site. Missed appointments may incur a return trip fee.
- Force Majeure. We are not liable for delays caused by events beyond our reasonable control, including supplier shortages, strikes, extreme weather, natural disasters, or government actions.
Pricing, Deposits, and Payment Terms
- Pricing. Prices are in U.S. dollars and exclude taxes, permit fees, disposal fees, and surcharges unless otherwise stated.
- Deposits. A non‑refundable deposit (commonly 50% for custom orders) is required to secure materials and production.
- Progress & Final Payments. Progress and final payment schedules will be stated in your contract. Final payment is due upon substantial completion of installation or delivery of materials, whichever occurs first, unless otherwise agreed in writing.
- Late Payments. Unpaid balances may accrue interest at the maximum rate allowed by law. You are responsible for collection costs, including reasonable attorneys’ fees.
- Ownership. Access Masters retains title to materials until paid in full.
Shipping, Delivery, and Risk of Loss
For materials delivered prior to installation, risk of loss passes to you upon delivery to your site or designated location. You agree to inspect deliveries promptly and note any visible damage on the carrier’s receipt.
Cancellations and Returns
- Custom & Special‑Order Items. Custom fabricated gates/doors, powder‑coated components, cut‑to‑length fencing, and electronics are non‑cancelable and non‑returnable once ordered.
- Stock Items. Returns of stock items (if accepted) must be unused in original packaging and may be subject to restocking fees and freight both ways.
- Service Cancellations. Cancellations within 24 hours of a scheduled service may incur a trip charge.
Installation and Safety
- Standards. We install to manufacturer instructions and applicable codes.
- Safety Devices. Where required, we include photo eyes, safety edges, entrapment protection, and signage. Bypassing safety devices voids warranties and is prohibited.
- Demonstration & Handover. Upon completion, we will demonstrate operation and provide basic user guidance. You are responsible for ongoing safe use and supervision, particularly around children and pets.
Maintenance and Homeowner Duties
Automated systems require periodic maintenance (lubrication, alignment, battery replacement, sensor cleaning, firmware updates). You agree to follow the maintenance schedule in the owner’s manual. Neglect, misuse, or failure to perform routine maintenance may void warranties.
Warranties
- Workmanship Warranty. Access Masters provides a limited workmanship warranty for [insert term, e.g., 1 year] from installation against defects in our labor under normal use. We will repair or re‑perform warranted work at our discretion.
- Manufacturer Warranties. Products are covered by their respective manufacturer warranties, which may have separate terms and claims processes. We are not responsible for manufacturer decisions.
- Exclusions. Warranties do not cover: normal wear and tear; cosmetic blemishes after acceptance; damage from abuse, impact, vehicles, vandalism, improper use, acts of God, power surges, lightning, rust due to environmental exposure (unless a finish warranty explicitly covers it), or alterations by others.
- No Implied Warranties. Except as expressly stated, we disclaim all implied warranties to the maximum extent permitted by law.
Service Calls and Emergency Support
- Standard Service. Service calls are billed at our then‑current rates plus materials and a trip fee.
- After‑Hours/Emergency. After‑hours or holiday calls may carry premium rates. We will make commercially reasonable efforts to respond but do not guarantee immediate availability.
Smart Devices, Connectivity, and Third‑Party Apps
Some systems rely on Wi‑Fi or cellular connectivity and third‑party platforms (e.g., manufacturer apps). Connectivity, app features, or subscriptions are outside our control and may change. You are responsible for network availability and any third‑party fees.
Intellectual Property (Website)
All content on the Site—including text, images, logos, product renderings, videos, and code—is owned by Access Masters or our licensors and is protected by intellectual property laws. You may not reproduce or redistribute Site content without prior written permission.
Reviews, Submissions, and User Content
If you submit reviews, photos, or other content: (a) you grant us a worldwide, non‑exclusive, royalty‑free license to use, reproduce, and display such content for marketing and operational purposes; (b) you represent you own or control the rights to it; and (c) you will not submit unlawful, defamatory, or infringing material.
Privacy
Your use of the Site is also governed by our Privacy Policy. By using the Site or our Services, you consent to our collection and use of information as described there.
Disclaimers
- Website Information. The Site is provided “as is” without warranties of any kind. Content is for general information and may include typographical or pricing errors. We may update or correct information at any time.
- Professional Advice. Installation and safety information on the Site is not a substitute for manufacturer instructions or professional assessment specific to your property.
Limitation of Liability
To the fullest extent permitted by law, Access Masters will not be liable for any indirect, incidental, special, consequential, or punitive damages, loss of use, loss of data, loss of profits, or business interruption arising from or related to the Site or Services. In no event will our aggregate liability exceed the amount you paid to us for the specific Service giving rise to the claim in the 12 months preceding the event.
Indemnification
You agree to defend, indemnify, and hold Access Masters, its officers, employees, and contractors harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your (a) breach of these Terms; (b) misuse of the Site or Services; or (c) violation of law or third‑party rights.
Dispute Resolution; Small Claims
Before filing in court, the parties will first attempt good‑faith resolution through direct discussions. Either party may pursue qualifying claims in small claims court on an individual basis.
Updates to the Terms
We may modify these Terms from time to time. The “Effective date” at the top will reflect the latest version. Continued use of the Site or Services after changes indicates acceptance of the updated Terms.
Severability; No Waiver
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of future enforcement.
Entire Agreement
These Terms, together with any signed quotes, work orders, and our Privacy Policy, form the entire agreement between you and Access Masters regarding the Site and Services and supersede prior discussions.
